Disability Hearing

Well the hearing part is over and I am so glad. I will get a decision in the next 60-90 days and will keep you guys posted. Normally the attorney knows after the hearing but I can't say that I had a good attorney. He said that he thinks it went OK but if not we will appeal. Sounds 50/50 to me.

  • was very hard to read. He only asked me a few questions. I noticed that he never made eye contact with me. He never looked up from his computer monitor even when he was questioning me. It was weird because my lawyer asked me all of the questions. Kind of like being cross examined. I have very strong medical evidence and doctor support so I think it will be OK. SSD sent me to their own doc in the beginning and they even agreed that I was disabled. It was shortly after my surgery so they just said that they did not believe that it would last 12 months or more. That was almost 2 years ago. My lawyer did say that my age is working against me because I am under 50. I am 46 almost 47. Thanks for all of the well wishes and I will keep you posted.

  • Very long days. I should hear between Christmas and my 30th anniversary in January. That is how I am keeping track of it anyway.
  • My age didn't hurt my case JJ. I was 46 years old in June when I won disability. Hopefully your age won't hurt you either. My medical was solid like yours and that should win it for you. Hang in there!

  • but honestly if you have your Doctors behind you and strong medical facts age shouldn't matter...

    Iam only 43 and I was awarded SSD in 8 months. I never had to see one their Doctors and never went through a hearing. I believe it was because of my medical records and my Doctor and surgeon was behind me 100%.
    I have a feeling your going to be awarded, and just think of all the back pay!!!
